General terms and conditions for the PlasticPortal website
I. General Provisions
• The company ICOSA s.r.o. with its registered office at 949 01 Nitra, Vodná 1119/9, ID No.: 36 809 608, registered in the Commercial Register of the District Court of Nitra, sec. Sro, File No. 20352/N (hereinafter referred to as the "Operator") is the operator of the Internet portal, which is located on the website www.plasticportal.eu.
• The portal www.plasticportal.eu (hereinafter referred to as the "Portal") is a public Internet portal, through which the Operator provides information, paid and unpaid services to natural and legal persons.
• These General Terms and Conditions (hereinafter referred to as "GTC") regulate the rules for the use of the portal, paid and unpaid services provided by the operator as well as the mutual rights and obligations of the operator, the visitor and the user of the portal in the provision of these services.
• Legal relations not further regulated by these GTC shall be governed by the relevant provisions of Act No. 513/1991 Coll., the Commercial Code, as amended, or other generally binding legal regulations in force in the Slovak Republic.
• The Operator is entitled to amend the content of these GTC at any time without the User's consent. The full text of the GTC after each amendment or supplement will be published on the portal together with the date of the last update, whereby the updated GTC become valid and binding. The Operator may reserve a different start date for the validity and binding force of the updated GTC, but not earlier than the date of their publication. The Operator is not obliged to inform visitors and users of the change to the GTC separately.
II. Registration
• A visitor is any natural person who accesses the portal and its subpages. A visitor is entitled to browse the portal without prior registration. Browsing the portal means in particular browsing company presentations, other forms of advertising, advertising, searching for manufacturers, retail outlets, wholesale outlets, products, materials, machines, offers, job opportunities by visitors to the portal.
• Registration is required if a natural or legal person is interested in using any of the paid services listed below (see Article V. GTC). A natural or legal person who validly registers becomes a registered user of the Portal (hereinafter referred to as the "User").
• Registration is made by completing and confirming the registration form. In the registration form, the user shall provide the following information:
1. name, surname, title
2. e-mail address
3. telephone
4. access name
5. access password
6. user's consent to sending information and data related to the portal
7. unconditional consent to the Terms and Conditions of the portal.
• The user is not entitled to cancel the registration himself. The registration may be cancelled exclusively by the operator at the request of the user delivered by email, mail or fax within 14 days from the date of receipt of the request. If the User who requests cancellation of registration is provided with a paid service at the time of the request (see Article VI. of the GTC), the Operator shall cancel the User's registration at the earliest on the date of termination of the provision of the service. The Operator reserves the right to cancel the User's registration and to prevent the User from accessing the Portal without giving any reason, unless otherwise specified below (see Article VI - Paid Services). In particular, the Operator may cancel the registration if the User violates these GTC or generally binding legal regulations in force in the Slovak Republic. The operator shall likewise proceed in the same way in the event that it discovers that the registration is unauthorised. The registration shall be deemed unauthorised if the registered user does not have legal personality (e.g. it does not exist, it is fictitious) or loses it after registration (e.g. the dissolution of a legal entity), if the user has not provided true data that allow it to be identified without confusion with another entity, if the user does not act on its own behalf when registering, if a person acts on behalf of the user - a legal entity, who is not authorised according to the entry in the relevant register to act on behalf of the user. In the event of cancellation of registration, the operator reserves the right to delete all the user's contributions and information about him.
• The user provides the operator with the data filled in the registration form for the purpose of providing portal services to the user, as well as for the purpose of carrying out marketing activities by the portal operator. The User hereby grants the Operator consent to make the provided data available to other users of the Portal, to process and handle the data and to keep records of the data to the extent necessary for the operation of the Portal. Consent is granted to the operator for an indefinite period of time and is granted by completing and confirming the registration form. Consent is granted voluntarily by the user. The user - a natural person provides the portal operator with the personal data provided in the registration form (first name, surname, full current residential address, telephone contact, email address). The provision of personal data is voluntary. By completing and confirming the registration form, the user agrees to the processing, collection, use of his/her personal data for the purpose of providing the portal services to the user as well as for the purpose of carrying out marketing activities (e.g. informing about products and services, inviting to professional seminars, conferences and trade fairs, conducting various surveys among users, processing the results of these surveys, if these activities are carried out when the user visits the portal) in accordance with Act No. 18/2018 Coll. on the protection of personal data. The user also grants the operator consent to the disclosure of his/her personal data to other users and visitors of the portal in the form of publication in connection with the services of the portal. The consent is granted for an indefinite period of time. The user is entitled to object in writing at any time to further processing (disclosure) of personal data.
• The operator guarantees the right to the users of the portal to:
1. to request information about the personal data stored,
2. to request their modification, correction or deletion,
3. the right to be informed about the modification or correction made,
4. the transfer of personal data, as well as the right,
5. to lodge an objection with the competent authority for the supervision of the processing of personal data
III. Rights and obligations of the user
• When using the services of the portal, the user must not violate the generally binding legislation of the Slovak Republic, the legislation of the country from which the portal is accessed, the principles of fair business dealings, the rules of general morality and decency. In particular, it must not openly or covertly promote violence, promote discrimination and incite hatred based on race, colour, nationality, sex, political beliefs, religion, promote the use of alcohol, narcotic drugs and psychotropic substances, use vulgarisms, publish pornographic materials, etc. Similarly, the user may not publish false, unverified, misleading information about another natural person or legal entity.
• The portal www.plasticportal.eu is a sector-specific Internet portal aimed at providing information and services in the sector of trading, processing and manufacturing of plastics and plastic products. The User may not post articles and other materials (hereinafter referred to as "Postings") on this portal that are unrelated to the plastics industry and trade and that are manifestly contrary to the purpose for which this portal was created.
• The Operator reserves the right to assess the compliance of the contributions posted by the user on the portal with the above rules and, in the event of non-compliance with these rules, reserves the right to remove them. In the event of removal of a post by the Operator, the User shall not be entitled to compensation from the Operator.
• The user is not entitled to any remuneration in connection with the publication of his/her contributions on the portal.
• The user is responsible for the content of the contributions he has published. The operator shall not be held legally liable for the content of the user's contributions, nor for any infringement of intellectual property or other rights by the user.
• The user must not damage the business name of the operator, other users or third parties. The user is obliged to formulate the content of his/her contributions in such a way as not to cause damage to the operator, other users or third parties. All forms of unfair competition within the meaning of § 44 et seq. 513/1991 Coll. of the Commercial Code are prohibited. In the event that the user causes damage to the operator, other users or third parties by the content of his/her contribution, the user is obliged to compensate for this damage in accordance with the generally applicable legislation.
• In the event that the Operator is sanctioned for the content of the User's contributions that are in violation of these GTC as well as the generally binding legislation of the Slovak Republic, or is obliged to compensate a third party for damages, the User is obliged to compensate the Operator for the damages incurred in full.
• The User is obliged to refrain from any action that would disrupt the operating system of the Operator or interfere with the operation or functionality of the services of the Portal, otherwise the User shall be liable for the damage caused to the Operator by such action.
- The user is obliged to refrain from any action that hinders or interferes with the discussion of other users of the portal. He must not harass other users by his contributions.
IV. Rights and obligations of the operator
• The Operator reserves the right to change the type of operation of the portal and the services provided, as well as to suspend the operation of the portal at any time.
• The operator is not liable for any damages arising in connection with the use of the portal, the impossibility of its use, its malfunction, technical failure, technical downtime, infection of the operating system of the portal.
• The operator strives to provide users with up-to-date and accurate information. However, the operator does not guarantee the timeliness, accuracy and correctness of the information published on the portal, nor does it guarantee the continuous functionality and uninterrupted operation of the portal.
• Intellectual property rights related to the functionality of the portal, its services, databases, visual design belong to the operator, or to third parties with whom the operator has concluded relevant contracts or agreements for this purpose. In the event of interference with or infringement of these rights, the operator will seek protection of the rights in civil and criminal proceedings.
V. Paid services
• The paid services of the portal are:
- advertisement - buying, selling, cooperation, labour market - offer and demand of work in the plastics industry and trade
- presentation of companies in the company catalogue
- banner advertising.
• The condition for using the paid service is user registration (see Article II of the GTC). Ordering the paid service is done by filling in the form called Extended Profile in electronic form. The contract for the publication of the extended company profile is concluded if the user completes and bindingly confirms the form. The subject of the contract is the implementation of the extended company profile in the PlasticPortal categories in the scope specified in the form.
• The User declares that he/she has been informed of the current offer and price of the Extended Company Profile and the services of the Operator based on the current price list / available on request, please contact plasticportal@plasticportal.eu
• The service shall be provided for a period of one year from the beginning of its provision, unless otherwise agreed by the parties. This contract may not be terminated by the user before the expiry of the time agreed in the order and/or in the form.
• The Operator has the right to refuse an order on the grounds of inappropriate content, origin or form of the requested service, on the grounds of an incomplete order, failure to deliver the documents for the advertising campaign, if the content of the order is contrary to generally binding legislation, these GTC, good morals or the principles of fair business practices and if it contradicts the purpose for which this portal was established. The Operator shall notify the User in writing (by e-mail, fax or post) of the refusal of the order; the refusal need not be justified in the notification.
• By concluding the Contract, the User gives the Operator permission to disseminate the advertising work via the Internet and confirms that he/she has settled the intellectual property rights to the subject matter of the advertising campaign in the territory of the Slovak Republic and, where applicable, outside the territory of the Slovak Republic.
• In the event that the user of the paid services violates generally binding legislation or these GTC, the operator shall invite the user in writing (by mail, fax, post) to eliminate the deficiencies and is also entitled to suspend the provision of the service to the user until the user makes corrections. For this suspension of the provision of the service, the user has no claim against the operator for damages or compensation.
• For the provision of paid services, the user undertakes to pay the operator the price according to the price list in force at the time of ordering the paid service.
• By agreement with the operator, the user may be provided with a price deviating from the price list.
• The user is obliged to pay the price of the service on the basis of an invoice issued for 100 % of the price of the service. The invoice shall be issued by the operator. The user is obliged to pay the invoice within 14 days from the date of issue.
• The invoice shall be deemed to be paid on the day the invoiced amount is credited to the operator's account - If the user has ordered a paid service, which is the presentation of the company in the company catalogue, the presentation will be published only after payment of the invoice.
VI. Complaints
• In the event of a shutdown of the portal for a period longer than 3 days, the user is entitled to compensation - i.e. the period for which the paid service was not provided due to the portal malfunction is extended by the period of service provision, provided that the user complains in writing to the operator about the portal malfunction without undue delay after discovering it. The written submission of a complaint shall be understood as delivery of the complaint to the operator by mail, fax or registered letter.
